Powers of Attorney

A power of attorney (POA) allows an elderly person to appoint a trusted person to act as their agent for handling specific responsibilities. These responsibilities may fall under the healthcare realm with a POA for healthcare allowing the agent to make health care and medical decisions. Another option is a POA for finances that gives the agent the power to make financial and legal decisions on the person’s behalf.

Guardianship

If an elderly client does not have a POA in place, or is not competent to create a valid POA, a family member may petition to act as the elderly person’s legal guardian. Guardianship involves proving to the court that the person is unable to effectively handle his or her affairs. Disputes can arise as to who should be guardian or whether a guardian is needed at all. We have experience working with families to resolve those disputes and getting the best person appointed as guardian.

TEDRA Petitions

TEDRA stands for Trust and Estate Dispute Resolution Act, and it provides a specific outline for dealing with disputes involving wills, estates and trusts in the state of Washington. The Act allows you to file a petition to resolve issues that can stem from conflicts over:

  • The terms or validity of a will, or competence of the individual who created the will
  • A person’s status as a beneficiary or heir
  • Inheritance claims if there is no will, or of surviving spouses and children left out of a will
  • Claims to an estate made by creditors or other third parties

Vulnerable Adult Petitions

Vulnerable adult petitions can help protect elderly individuals who may be victims of elder abuse. Filing such a petition offers temporary protection that can be extended if abuse is proven in court.
